Terms and Conditions of Sale

Any order implies prior consultation and acceptance of these Terms and Conditions of Sale, which are accessible at any time via a permanent direct link on our website. In the absence of well-established legal texts in certain countries (including the United States), we have chosen to apply French standards, which we consider a reasonable compromise. You will find references to these legal texts here.

These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between EmmanuelleGuyon and the customer, with both parties accepting them without reservation. These T&Cs take precedence over any other general or specific terms not expressly approved by EmmanuelleGuyon.

Accordingly, the customer acknowledges being fully informed that their agreement to these terms does not require a handwritten signature, as long as they wish to order the products presented in the website’s catalog. The customer may save or print these terms at their discretion, with the understanding that doing so is their sole responsibility. It is also understood that acceptance of these terms is a necessary step to finalize the order, and that placing an order implies unconditional acceptance of these T&Cs.

We reserve the right to suspend any order processing or delivery in case of refusal of payment authorization by officially accredited organizations or in case of non-payment. We also reserve the right to refuse delivery or fulfillment of an order from a customer who has not fully or partially settled a previous order or with whom a payment dispute is ongoing. Such suspension or refusal does not engage our liability and does not give rise to any compensation.

Payment methods

You have several payment options available:

  • By bank transfer: Once you have selected your item(s), please contact us to obtain the banking details required to make your transfer. We will provide you with the necessary bank account information. Please note that in this case, the shipment of the ordered products can only be made once our bank has confirmed the transfer, which may result in an additional delay in the delivery of your order.
  • By PayPal: Once you have selected your item(s), click the “Pay” button and complete your payment through the merchant site. If you do not have a PayPal account, no problem. You can also pay via PayPal without creating an account, using only your credit or debit card. Click here if you want to know how to pay with PayPal without opening an account. The PayPal payment system is known for its security and reliability, offering enhanced protection for your online transactions.

How to purchase

By PayPal or by credit/debit card through this payment system, select the item(s) of your choice on our website by clicking the “Add to Cart” button. You can access the summary of your cart at any time before the order is finalized, allowing you to correct any errors in the entered information. The order is only recorded once the payment has been confirmed.

For payment by bank transfer, please send your order to contact@emmanuelleguyon.com. We will then provide you with the necessary information to complete your payment.

REMINDER: Confirmation of the order constitutes acceptance of these Terms and Conditions of Sale, acknowledgment that you have read and understood them, and a waiver of any personal purchasing conditions or other terms. All information provided and the recorded confirmation will serve as proof of the transaction. The confirmation will be considered as a signature and acceptance of the completed operations.

Shipping fees

Shipments are made via the Mexican postal service, "Correos de México," from Mexico, where we currently reside.

Shipping is free. Your package is sent via registered mail with a tracking number, allowing you to follow the progress of your order from Mexico to its destination. You can monitor its journey at every stage, from pickup by the postal service to delivery at your address.

We also offer an Express shipping option via private courier, which significantly reduces delivery times. You will find this option in your shopping cart. Choosing this service ensures fast and secure delivery, ideal for urgent orders or last-minute gifts.

As with all international shipments, your order may be subject to customs fees. Each country sets its own rates, and it is the customer’s responsibility to check with the relevant authorities regarding any charges that may apply to their order. You are solely responsible for any additional costs imposed on your order. We recommend checking your country’s customs regulations before placing your order to avoid any unpleasant surprises upon delivery.

Delivery times

Delivery times via postal service are generally 2 to 3 weeks, but can extend up to 6 weeks or more during holidays or festive periods. It is important to note that these delays are normal and correspond to increased demand during these times.

If the jewelry piece is already made, it will be shipped within 2 to 3 days following receipt of your payment. However, for custom orders, such as a made-to-measure ring, please allow a production time of 5 business days. This timeframe may be extended depending on the complexity of the customization, including the design, testing, and creation phases required to meet your specific requirements.

We disclaim any responsibility for delays caused by postal strikes, public holidays, long weekends, or festive dates. Furthermore, we are not responsible for possible delays resulting from customs clearance, which may vary from country to country.

Any delay or failure to perform the services provided under these terms cannot be considered a fault attributable to our company, provided that it can be shown that the delay or failure results from the client’s actions, an unforeseeable and unavoidable event caused by a third party to the contract, or a force majeure event as defined by applicable law, in accordance with Article L. 121-20-3 of the French Consumer Code.

According to this law, we cannot be held responsible for delays or loss of an order once we have properly processed and shipped your order, as evidenced by the postal receipt confirming the dispatch of our work to you. At this stage, the law does not obligate us to refund your jewelry in case of an issue. However, we always strive to ensure customer satisfaction and, as online buyers ourselves, we understand the importance of resolving such problems as effectively as possible.

We may file a claim with the postal service if a package has been in transit for more than one month from the shipping date. A postal investigation can take up to one month from the start date of the inquiry. However, in exceptional circumstances, this period may be extended further. Rest assured, we will keep you informed of any developments throughout the process.

  • If the product is located during this period, it will be immediately reshipped to your address in most cases. However, please note that in some cases, reshipping fees may apply, particularly if the package was returned due to an incorrect or incomplete address provided by the customer. We will contact you in such cases to discuss available options.
  • If, however, the product is not found after the 31-day investigation period, it will be considered lost. Only at that point can we begin discussions with the customer to resolve the issue. This may involve sending a replacement item at our expense. We may also consider a partial refund, the amount of which will be determined on a case-by-case basis depending on the minimum costs incurred (materials, labor, etc.). We emphasize that we do everything possible to avoid such situations, but in the event of loss, we commit to finding a fair and satisfactory solution for all parties involved.

Definition of jewelry type

In our terms of sale, we distinguish two categories of jewelry available in our online store.

  • Category A: This category includes all the jewelry offered for sale on our website that does not require customization. It covers all pieces listed in our shop (with the exception of rings where you must specify your size), as well as rings available in a single size mentioned in the description of the piece.
    We also include in this category custom-made jewelry based on your wishes and designs, provided that it does not contain any personal elements (such as a name, date, personal quotation… this list is not exhaustive). Please contact us if you would like to confirm whether your order falls into this category.
  • Category B: This category refers to customized jewelry created based on your specific requests, with a design you provided, or including very personal elements such as a birthdate, a name, etc. These pieces fall under Article L121-20-2 of the French Consumer Code, which does not require a refund for "goods made to the consumer’s specifications or clearly personalized…".
    This category also includes all rings or bands for which you must choose a size. We are not a company producing rings in large series with a wide range of sizes available for standard exchanges. Each ring is a unique handmade piece that requires several hours of work, along with an investment of precious and non-precious materials, and wear on our tools. Since a ring made in your size is specific to you, it is very difficult to resell it in case of return, as it would require finding another customer with the exact same size. This is not feasible for us or for our stock management.
    We therefore rely on you to provide your exact finger size, as choosing the correct ring size is an essential step in the creation of your jewelry. Please note that we always insist on and take the time to determine this measurement with you, in order to avoid any complications with your order. Order cancellation

A cancellation of an order for a Category A jewelry piece will be accepted only if the item has not yet been shipped. To cancel an order, please send a cancellation email to contact@emmanuelleguyon.com as soon as possible.

If the item has already been shipped, please refer to the Refund section.

For a Category A piece, the cancellation will take into account any transaction fees incurred during your purchase. This specifically concerns PayPal fees, which amount to 5% and will therefore not be refunded. Please take note of this policy before finalizing your order.

For Category B jewelry, i.e., personalized pieces, no order cancellation will be accepted once the item has been created. This is because these pieces are custom-made according to your specifications, making resale difficult. We thank you for your understanding in this matter.

Withdrawal period

In accordance with Articles L121-16 to L121-23, and in particular L221-18 of the French Consumer Code, you have a period of 14 days from the date of receipt of your package to withdraw from your purchase, for any reason. This withdrawal period applies only to Category A jewelry. Please note that personalized jewelry, belonging to Category B, is not eligible for this withdrawal period, as it is made according to your individual specifications.

After notifying us, the jewelry must be returned in good condition. Shipping costs and risks are the responsibility of the customer. Please send your package with a tracking number, and ensure the jewelry is carefully wrapped in its original protective box. Refunds will not be issued until we have received the item. If your return package is lost because it was sent without a tracking number, no refund will be provided.

Unless the return is due to our error, return shipping costs are your responsibility. In the case of a defective product, we will cover all costs incurred by the customer.

Jewelry that has been worn, altered, and/or engraved cannot be returned or exchanged. Category B items (special orders, personalized pieces, rings made to a specific size at your request), which fall under Article L121-20-2 of the French Consumer Code, are also not eligible for return or exchange.

Refunds

Once the jewelry is returned to us in perfect condition, the refund will be processed according to the category of the item:

For a Category A piece, the cancellation will take into account any transaction fees incurred during your purchase. This specifically concerns PayPal fees, which amount to 5% and will therefore not be refunded.

For Category B jewelry, that is, personalized pieces, no refund will be issued except in the case of a manufacturing defect that can be attributed to us. These items fall under Article L121-20-2 of the French Consumer Code, which does not require a refund for "goods made to the consumer’s specifications or clearly personalized…".

If the issue is related to ring size, we use standard sizing and the best materials to ensure that the piece is made according to your request. We take a photo of each ring on a triboulet (ring mandrel) as proof that the specified size has been correctly realized. Therefore, we cannot be held responsible for any measurement error on your part, and no refund will be issued in this case, since the ring was produced exactly as requested.

If you need to adjust the size, we invite you to consider the following options:

  • We are unable to resize rings with stones due to technical constraints.
  • For a ring made entirely of silver or gold without stones, we can enlarge the size by up to one additional French size. This service is available for a cost of €15.
  • We can reduce the size of your ring if technically feasible. The cost of this operation will depend on the complexity of the task.
  • Initial shipping fees as well as any return shipping costs are the customer’s responsibility.
  • Refunds will be issued either via PayPal or by check, according to your preference.

Note:

  • All stones used in our jewelry are natural, which means they may have inclusions, impurities, and/or imperfections. These characteristics do not constitute a reason for a refund.
  • We take all necessary precautions to minimize the risk of allergies. All our jewelry is guaranteed nickel-free. However, as each individual may react differently to products and materials, we cannot be held responsible for any allergic reactions that may occur. Therefore, products will not be refunded in case of allergy.
  • All our silver jewelry is made from 925 silver, which means it contains 92.5% pure silver and 7.5% copper.
